    In the Name of God Amen. I, Daniel Neal of the county of Bedford being in a low state of health but of perfect mind memory and understanding, and knowing that is appointed for all men once to die but knowing the uncertainty thereof do make this my last Will and Testament in manner and form following. First of all I recommend my soul to Almighty God, who gave it, my body to the dust from whence it came, and for such wordly good as it hath been God to bless me with in this life I dispose of as follows to wit, I hereby lend to my beloved wife, Mary Neal, my whole estate real and personal after all my just debts are paid during her natural life, and then the whole so lent, that remains at her death to be equally divided between my five children here after named Walter and Zephaniah Neal, Betty Steal, Mary Varnum, and Margaret Millam, to them and their heirs, forever. I do hereby appoint my beloved wife Mary Neal and my son Zephaniah Neal executors of this my last will and testament. Witness whereof I have hereunto set my hand this seventh day of March one thousand seven hundred and ninety one. Signed and sealed in the presence of Henry Jeter, John Chastain Jr., Thomas Terry. MEMORANDUM that on the day above written I do impower my executors to make a deed in fee simple to Thos. Logwood and Francis Steal for the lands I sold to each of them. Signed by Daniel Neal.

    Bedford County, Virginia Transactions:
    1.) 7 Jan 1764. Amherst Co., VA deed for Daniel O'Neal from John Robinson 304 A. on Meachum adj. Jno. Roads.
    2.) 25 Apr 1769. Purchased 225 acres for 50 lbs. on Oslin Creek (graveyard excepted) from John & Agnes Wood. Land was by that of Jarvis Jackson, and on both sides of above named creek.
    3.) 28 Dec 1770. Deed of trust on 225 acres purchased from John Wood to William Hook, who is acting for William Donald Jr., merchant, to whom John Wood had given Daniel Neal's note.
    4.) Jul 1771. Served on Jury Duty in case of Mead vs. Dillaney.
    5.) 26 May 1772. Gave deed of bargain and sale to William Calloway Sr. and Zachariah O'Neal for amount of 50 lbs. as his security for deed of trust and for this offers one slave, Sambo, 2 horses and 8 head of cattle on the condition that if he does not pay back the 50 lbs. security that Calloway and O'Neal furnished then the cattle, horses and slave is to go with them.
    6.) 15 Feb 1781. Had 300 acres surveyed for himself on Oslin and Sycamore Creeks, adj. to Tracy's line to Nancy Neal's line, to Oslin and down. Land warrant #17448.
    7.) Nov 1788. Ordered to court to answer in regard to treatment of indentured servant, Joshua Roberts. Summoned to appear Mar 1789.
    8.) 24 Jan 1791. Gets 275 acres from James Buford on north fork of Otter River, adjoining William Boyd and Peter Harmon.
    9.) 1 Nov 1795. To Thomas Noell 200 acres on Oslin Creek.
    10.) 25 Jan 1796. To Thomas Noell 84 acres on Sycamore and Oslin.
    11.) 26 Feb 1798. Exempted from roadwork under Cornelius Noell, surveyor.

    Will of John Neale (Planter) of Charles County, Maryland; Made 5 Oct 1733, Probated 5 Nov 1733 in Charles Co., Maryland. Volume III, Page 272:
    To Son John, 50 acres beginning on east side, and ending on south side of Clarks Branch, called Neale's Chance or Choice. To daughter Margaret Scott, 1 metal kettle, 3 quarts size and one milled shilling. To son William two draught horses (Giles & Dunn). To son Barton one iron pot holding 2 1/2 gals. To son Daniel one feather bed and furniture when he is 18 years old. With whatever else he gets to be equally divided among his children: William, Barton, John, Charles, Daniel, Benjamin, Zachariah, Jacob, and Catherine; all to be left for themselves at the age of 16 years.     Is this the John Neale who petitioned Humphrey Warren for freedom from servitude in 1691? If so, then the birth year is probably closer to 1670 instead of 1687.

    There has been speculation that John Neale may somehow be related to the Capt. James Neale family, also of Charles Co., MD. Here are a few facts gathered on the early Neales:
    1) 31 Dec 1619. Raphael Neale was brought in by the Marshal of Middlesex, England (London is in Middlesex) and kept to go to Virginia. This Raphael had been involved in a duel with swords with William Rowe, gentleman. Ordered to appear 13 Apr 1618. This Raphael is the father of Capt. James Neale born in 1615 and emigrated to Maryland in 1635.
    2) 4 Jul 1635. Mr. Edward Walker, by certificate from the Minister of Gravesend transported Jonathan Neale, aged 12 from London to Virginia.
    3) 26 Apr 1637. Joseph Clifton, ex. of Daniel Hopkinson (merchant). Turned over to John Neale - Francis Seymour, Mr. Wallis' servant at London.
    4) 18 Jun 1638. Deposition re: accounts for tobacco rec'd by Francis Smith in Virginia from John Brush, Alexander Gardiner and John Haynee, planter; and John Neale and Capt. Henry Browne.
    5) 7 Oct 1641. James Neale of Virginia, Gentleman, appointed as attorney to recover debt for John Pennell, citizen and draper of London due from Bartholomew Hoskins.
    6) 17 Jun 1660. John Neale of Exeter, Devonshire, yeoman and Robert Rodes, yeoman, bound to Austin Wakely, mariner to serve 5 years; by "Delight" for Virginia.
    7) Aug 1675. Administration of Thomas Neale of Maryland.

    14 Mar 1715; John Neall attested the will of Thomas Lilley a Chirugeon barber. Lilley left his entrie estate to Jacob Miller the current husband of John's mother-in-law, Margaret.

    William emigrated from England in 1646, probably to Virginia and then to Maryland in 1647. It was common for settlers to go over into Virginia for a time and return to Maryland to claim more land. On 7 Apr 1648 William White claimed 100 acres of land for Hungerford's arrival in 1646.

    Notes:

    Ann Smoot Hungerford was the widow of William Hungerford and mother of their son, William Hungerford. Testimony on 13 August 1661 "6 or 7 years ago, before she married William Hungerford, he paid Mr. Hatch 2 heads of tobacco for the use of Mr. Cager, etc." On that date, 13 Aug 1661, Ann Barton was declared 20 years old and upwards, therefor born about 1640. Liber PCR folio 480. On the same day, Humphrey Atwicks who had married Elizabeth Smoot declared Ann Barton, formerly Ann Hungerford was his sister-in-law.

    With father from Warwickshire, England about 1654 to Virginia to Maryland, purchased 300 acres on St. Clement's Bay in 1658.

    A mariner and planter, served as Justice of St. Mary's County and on the Potomac in St. Mary's County from 1658 to 1660; on Governor's Council 28 Feb 1669. Commissioned a justice of the peace for Charles County, MD 1 Aug 1672 and served until about 1687. Member Church of England.

    At a meeting of the Council heald at Mattapanye on 16 Jun 1676, the Council ordered the "Mr. Benj. Rose and Major Wm. Boarman received the foure Indian prisoners from Capt Lieut. Barton and convey them safely Over to Collonel Nicholas Spencer and in his absence to Lieut Collonel John Washington or Major Isaac Alderton" 207 (Archives of MD, Vol 15, page 92).

    In 1683 he was on the committe for the advancement of trade in Charles County. In 1687 he was recommended for the council and in 1689, he was member of the commisssion to regulate civil affairs in the county and was to retain his commission.

    On 22 Sep 1687, a council held in St. Mary's City appointed Capt. William Barton to a "new commission of the Peace and Tryall of Causes" for Charles County. At his recommissioning on 26 Nov 1678, he was called Capt. William Barton. In 1681 he was a Magistrate of Charles Co. Court in MD and was Captain of the Foot (infantry) of the Provincial Militia.

    1689: William Barton signed a petition as a "Protestant Subject of Their Most Excellent Majesty King William and Queen Mary". He served as a vestryman in Port Tobacco Parish.

    1696 listed as a civil officer of Charles County.

    William Smoote, the father of Ann (Smoote) (Hungerford) Barton assigned to William Barton Jr. and Thomas Smoote and their heirs, forever, a patent for 240 acres granted to him on May 26, 1658.

    At Court, Charles Co., MD Oct. 1, 1662, William Barton Jr. delivered the patent his father-in- law, William Smoote, assigned to him and his brother-in-law, Thomas Smoote on May 28, 1658, quoting: "unto his Brother-in-law Thomas Smoote for the use of William Hungerfot Junior, son of William Hungerfot, deceased." Libe A, Folio 243. His first wife Ann, evidently died in the year 1662 and for this reason the above land was returned to the child's relatives for his benefit.

    Among those chosen by the principal freeholders for vestrymen and appointed at a Court held at Benedict Leonard Town on Feb 14, 1692 was Mr. William Barton. Liber K, Folio 152, 153. Later he was one of six vestrymen for Church at Charles Town called St. Pauls Parish around 1696. Liber H D, Folio 47. He was also a Vestryman for a parish at Port Tobacco, MD. Liber H D, Folio 47. This was the William and Mary Parish in Charles Co., MD.

    9 Aug 1681 recorded as Capt. William Barton, Commissioner, Liber Bf.223 Md. Arch. Vol 15, page 405. In 1684 named among those regulating the affairs of the Militia in Charles County Maryland and referred to as Captain many times.

    This deed proves the marriage of Mary Barton to Thomas Warren and the marriage of her sister, Elizabeth Barton to Thomas Smoote. It also proves William and Mary Barton were their parents and their marriage was solemnized before June 13, 1688, the date of the deed. "This indenture made the 13th day of June in the thirteenth yeare of the Dominion of the Right Honorable Charles Lord Baltimore Absolute Lord and Protector of Maryland on and in the year of our Lord one thousand six hundred Eighty and Eight between William Barton Jr. of Charles Co. in the Province of Maryland Gentleman of the one part and Thomas Warren of the aforesaid county and Province Planter and Mary his wife the Naturall born daughter of the said William Barton of the other Part witnesseth that the said William Barton for and in consideration of that Naturall lova and fatherly affection which he hath and doth always bear unto the said Mary his natruall borne Daughter the wife of the said Thomas Warren and also for divers other good causes and considerations him hereunto more Especially moveing hath given, granted Confirmed and by these presents Doth fully and Absolutely give grant and Confirme unto him the said Thomas Warren and Mary his wife all that Parcell of land called....? Swamp lying in Charles County and beginning at a bounded white oake standing in the woods on the west side of Zackyah Swamp about a mile for the said ...? Swamp in the north and by west line of Nathan Barton land formerly taken up by Daniell Johnson" . ....... which said two Parcells of land conteyned by estimation about one hundred and forty eight acres together with all and singular the Houses buildings and edifices...... the said two parcells of land unto him the said Thomas Warren and Mary his wife to the only proper use and behoofe of him the said Thomas Warren and Mary his wife During theire natural lives and to the heirs of theire body lawfully begotten or to be begotten forever and in case of default of such I give then the said two Parcells of land are hereby given granted and Confirmed unto Thomas Smoot and Elizabeth his wife the natural borne daughter of him the said Wm Barton to have and to hold the aforesaid two Parcells of land and all and singular the premises with their and Every use and behoofe of him the said Thomas Smoot and Elizabeth his wife during their natural lives and to the heirs of her body lawfully begotten or to be begotten forever. ........ and the said William Barton and Mary his wife have granted for them and their heirs that they will warrant to the said Thomas Warren and Mary his wife during their natural lives and the heirs of her body lawfully begotten or to be begotten them within mentioned given and granted premises with the Apurtenances and for Default of such issue as aforesaid to Thomas Smoote and Elizabeth his wife during theire natural lives and to the heirs of her body lawfully begotten or to be begotten agt. him the said William Barton and Mary his wife and their heirs and agt. all other persons whatsoever according to the forme and Effect of the within written Indenture. Witnessed by Randolph Henson and John Addsion. Signed by William Barton and Mary (her mark) Barton.

    27 Mar 1689 William Barton signed an article assuring the citizens there was no planned disturbance by Indians and Roman Catholics and the purpose to kill Protestants was false. (PRO Colonial Papers, Vol. 8 Md. Arch 1687-1693. Was named at the Court at Whitehall 8 Oct 1691 as one of the most substantial Protestant inhabitants - PRO Colonial Papers, folio 8 (ibid p. 285).

    26 May 1658, William Barton Jr., delivers patent and assigns rights to his rights to his brother in law Thomas Smoote for the use of William Hungerford Jr. son of William Hungarford, dec'd. Patent granted to William Smoot by assignment from John Lugar Jr.; 240 acres lying on the west side of Wicomico River at the head of Forked Creek, Monor of St. Mary's; bounded by Humphrey Atwicks and Thomas Mitchell endorsed from William Smoot to William Barton Jr. and Thomas Smith.

    12 Jul 1664 Daniel Johnson assigns right to William Barton Jr. for 100 acres "Johnson's Enlargement" in the branch of Zachia Swamp. Charles County Land Records B.339.

    9 Jan 1670; Sam Fendall, Gent., sold William Barton, Gent., :Daniel Mount" on west side of Wicomico; also "Johnson's Retirement", containing 100 acres. Charles County Land Records E.22 V.2.

    1 Sep 1670; Barton's Enlargement granted to William Barton by patent in Charles County bounded by said Barton's dwelling plantation, containing 50 acres. Charles County Land Records O#2.336. (Later sold by Sanuel Perrie).

    Will Of William Barton; 5 Sep 1717. In the Name of God Amen. I William Barton of Charles County in the Province of Maryland Gent & being very Sick & weak of body but of Sound & perfect mind and memory Praised be almighty God for the same & Considering the frailty of human life & that all must yield when God by Death is pleased to Call doe make this my last Will & Testament in manner & Form Folowing hereby Disannulling & making voyd all former & other Will or Wills by me here to fore made Imprimis. I Give my Soule to almighty God Trusting & Relying upon the full pardon & Remission of my Sinns through ye merritts and Intercession of my Blessed Saviour & Redeemer Jesus Christ. My Body I committ to Earth to be buryed in such decent manner as my Eccds hereafter named shall think most convenient. And as for what worldly Estate God hath pleased to bless me with I Dispose of the Same as followeth. Item) I Give & bequeath unto my grandson Barton Smoot my Negroe man Samm & doe hereby Desire him to use him Kindly during his natural life knowing at was my intent if the Laws would have permitted to have given him his freedom. Item) I Give & bequeath unto my Grand Daughter Rachel Stone the Wife of Matthew Stone the feather bed & Furniture that I now Lye on. Item) I Give & Bequeath unto my Grand Daughter Ann Smoote two cows with Calves by their sides to be Delivered after my Decrease by my Eccs. Item) I Give & Bequeath unto my Grand Daughter Mary Hungerford two young cowes or Yearling Heifers to be Delivered as afsd. Item) I Give & Bequeath unto my Grand Daughter lizabeth Philpott the Wife of Charles Philpott the Featherbed & Furniture belonging to the same which is in the Great House Room to be delivered as afsd. Item) I Give & Bequeath unto my Grand Son Barton Warren two young Cowes or Heifers of two years old also one full share of my present Crop of Tobacco. Item) I Give & Bequeath unto my Grandson William Smoot one full share of my present crop of tobacco. Item) I Give & Bequeath unto my Grand Daughter Elizabeth Neale, Wife of John Neal one Cow & Calfe & Forty Ells of Linnen. Item) The Full Halfe of all the Remaining part of my Estate of what Nature or kind soever it be or wheresoever the same shall or may be found I doe Give & Bequeath unto my Daughter Margaret Miller & her three youngest Children, the other halfe part I doe give and bequeath unto Thomas Smoot & Barton Smot the two sons of my Grand Son Barton Smoot. Lastly) I doe hereby Nominate Constitue Ordain & appoynt my Daughter Margaret Miller & my Grand Son Barton Smoot to be jointly Eccts of this my last Will & Testament desiring them to doe & performe every article & Cause herin Contained. Howard, John Jones, JW Willard.William Barton was too sick to sign his will and had to make a mark. Court records prove he could read and write.

    Appraisal of his personal estate was filed 19 Oct 1717 citing a value of 152 lbs, 9 shillings, 9 pence, including among other items, one negro and a parcel of books. (Inventories and Accounts, Liber 39C, folio 49).
