In the Name of God Amen, I, PETER VOLTZ of the County of Shenandoah and State of Virginia, being weak and infirm in my body, but of sound mind and disposing memory (for which I thank God), and calling to mind the uncertainty of human life, and being desirous to dispose of all such worldly estate as it has pleased God to bless me with... I give and bequeath the same in manner following that is to say, I give and bequeath unto my son GEORGE VOLTZ his Heirs and assigns forever, all my plantation and lands whereon I myselft and my son GEORGE now live in the county of Shenandoah on the drains of Stony Creek containing two hundred and eight acres to be the same more or less..to wit.. two tracts or surveys the one containing one hundred and forty eight acres and the other sixty acres..it being the same plantation and lands which I purchased of Michael SHOEMAKER, with, all and singular the apurtenances thereunto belonging, subject nevertheless to the payment of the specific legacies which I shall herein-after give to my nine daughters and to the children of my daughter ELIZABETH STICKLY, dec'd. Item I give and bequeath unto each of my daughters to wit, MARY the wife of John WILLFANG, CATHARINE the wife of DANIEL STOUT, MARGARET the wife of George DELLINGER, MAGDALENE the wife of Emanuel DELLINGER, SUSANNAH the wife of Henry HOSHAUR, ROSINAH the wife of Jacob HELSLEY, Junr., and BARBARA the wife of George ANDERICK and their Heirs the sum of ten Dollars and I also give ten Dollars to the Children of my daughter ELIZABETH STICKLY, dec'd. to be equally divided amongst them and my son son GEORGE VOLTZ or whosoever possess the plantation and lands, I have hereby given him as above mentioned shall pay the same in the following manner to wit: ten dollars which I have given my eldest daughter MARY WILLFANG he shall pay within twelve months after my decease, and then he shall pay ten dollars that is to say one legacy every year afterwards untill the whol ten legacies are fully paid always perferring the eldest of my said daughters before the younger in paying the said legacies. But if either of my said daughters should die no Child or Children after her death, then my said son GEORGE VOLTZ his Heirs and assigns Shall not be obiled to pay that legacy if he has not paid it before such death. Item all my wearing apparel and my Books I give and bequeath unto my three sons namely, JOSHUA VOLTZ, JOSEPH VOLTZ, and the said GEORGE VOLTZ to be equally divided amongst them, and after payment of what nature or kine 'soever it may be, not herein before particularly disposed of, I desire may be equally divided among all my Children herein before named which I give to them their Heirs Executors Administrators or Assigns forever. And Lastly, I do hereby constitute and appoint my said son JOSHUA VOLTZ sole Executor of this my last Will & Testaments by me heretofore made, Ratifying this and no other to be my last Will & Testament. In Witness Whereof I have hereunto set my hand and affixed my Seal this fifth Day of June in the Year of our Lord One Thousand Eight Hundred and Seven.

Catherine Stauten born Boltzen, was born in the year 1755, the 21st of March, in the county of Shenandoah, Virginia. Her father is Johann Peter Boltzen and her mother Maria Elishabetha Boltzen, born Mintzin.
The parents are donating this book to their daughter for her memory and to remind her that she shall remember her parents and shall pray incessently to God and shall remember also that she has been baptised, also that she will not betray and will not abandon the truths of God and so that she will not come into wrong doing, for you should have all your life long God before your eyes and in your heart, and you shall be ware yourself not to agree to any sin or act against the commands of God.

Catherine Stauten born Boltzen got married to her husband Daniel Stauten in the year 1772, the 3rd of March.

Note: The above was translated by Dr. Martin Wadewitz, Chief Chemist of the American Glanzstoff Corporation, Elizabethton, Tennessee, August 23, 1933. Dr. Wadewitz is a native of Germany.

WFT #1391 - Godfrey changed his German surname Staudt to Stout. Godfrey thought Stout sounded more American. Godfrey's wife left a will in Johnson County, Tennessee (Will book 1, pg 27, dated September 26, 1843, pvd. April term 1846).

In 1860 Henry Stout gave 50 acres land to "the wife of Samuel Stout", no name, no claim as to relationship." From Will E. Pension Deposition: [Keziah GENTRY WRIGHT STOUT, widow of Henry STOUT, submitted her application to receive a Widow's Pension based on Henry's service in the War of 1812. Abstracted:]
"...November, A.D. one thousand eight hundred and Seventy eight... Kizziah Stout...a resident of Stoney Creek, in the State of Tennessee Carter County...declares that she is the widow of Henry Stout deceased...a private in the Company commanded by Captain William Naileys in the Virginia Regiment of Militia...in the war of 1812...she was married to the said Henry Stout...in 7th Civil District, in the county of Johnson, and in the State of Tennessee, on the 8th day of March A.D. 1861 by one H.P. Murphy...; and that her name before her said marriage was Kizziah Wright; and she further states that said Stout had a former wife by the name of Dolen who died many years ago but don't know when or where and that her said husband Henry Stout, died on Stoney Creek, in the State of Tennessee Carter Co., on the 26th day of October A.D. 1878; and she further declares that the following have been the places of residence of herself and her said husband since the date of his discharge from the Army, viz; in Johnson & Carter County Tennessee since their said marriage before she
cannot state...her said husband was a pensioner...that her residence is...county of Carter State of Tennessee, and that her post office is Carters Furnace Carter County, Tennessee...Kizziah Stout (signed her "x" mark)...[witnessed by] C.C. Collins and Isaac H. Brown."

"June the 18th 1816
Dear Friend
This is now the 4th letter I send you without getting an answer. I thought to try once more if perhaps I might get some word from you Tommy came to my House a short time before christmas he was not alltogether well and complained of the yellow jaundice which was curet, but a very bad Cough he had till he died, we had different Doctors to attend him the last was David Neaf whose skill is much spoken of but all in vain for he departed this life the 2nd March last (past). About his clothing we know not what to say, but want to hear from you what we are to do with them. He desired that I should send them word that they should not live as he had, and he had done But to Change their way of living as they hoped to be saved, not only one of you But Father, Mother sisters brothers and all Relations; He said as he could not see you here no more he was sure he would see you all at the day of the general Resurection. Please to come and fetch his Clothing for the do us
no good he had no debts, and I make no Charge you have noghint to pay for him I paid all; we are all well at present Joshua Foltzes wife died soon after Thomas---And we hope these lines will find you all well.

Notes:

Johnson County, Tennessee was established by the legislature of Tennessee out of the upper part of Carter County. It is in the extreme northeastern portion of the state. In the days when men had to cut their way through the mountains it was the "gateway" into Tennessee. General James Robertson came down Roane Creek, and stopped at the cain of Honeycutt for some time, on his first trip.

I, Nicholas Grindstaff have this day bargained and sold, and do hereby transfer and convey to David Stout of Rones Creek and his heirs forever, for the consideration of one hundred dollars to me paid a tract of land in the State of Tenessee Johnson County and district number 5 containing by estimation forty acres be the same more or less and bounded as follows. Beginning on a chestnut sprout with pointers near Nicholas Grindstaffs line about five poles from a white oak corner to Nicholas Grindstaff Junr. and George P. Stout, thence running
south fifty two de. east eighty three poles to a hickory & maple with pointers on the side of the Mountain, thence south sixty de. west ninety poles to a double read oak with pointers corner to said entry, thence a direct course to the beginning, to have and to hold the same to the said David Stout his heirs and assigns forever. I do covenant with the said David Stout that I am lawfully seized of said land, and have a good right and title to convey it and that the same is unincumbered. I do further covenant and bind myself my heirs and representatives to warrant and defend the title to the said land and every part thereof to the said David Stout his heirs and assigns against the lawfully claim of all persons whatsoever, this the 17th day of January 1838.

In the name of God Amen. I David D. Stout of the County of Johnson and state of Tennessee being of Sound mind and memory and considering the uncertainly of this frail transitory Life do therefore make ordain. publish. and declare this to be my Last Will and Testament that is to say. First after all my Lawful debts are paid and discharged the residue of my estate real and personal. I give bequeath of as follows. to wit.
First. I give and bequeath to my beloved wife Anna Stout all the Land and personal property that I may die seized and possessed fo during her natural Lifetime and then after her death to be divided equally between my daughter Eliza and my son Abraham. Second after willing the balance of my children what I have already give them. I give and bequeath to my son Samuel Stout One Dollar in Lawful money of the United States. Third I give and bequeath to my son Alfred One Dollar Lawful money of the United States. Fourth I give and bequeath to my daughter Nancy Shuffield One Dollar Lawful money of the United States. Fifth I give and bequeath to my daughter Sarah Campbell One Dollar in Lawful money of the United States. Sixth I give and bequeath to my son Godfrey D.
