Vestal once said that John Webster (c.1759-1833) was born in Albemarle
Co, VA. I have found that most other researchers say that John Webster
was likely born in Amherst Co, VA. According to his pension
application file, he lived in Amherst Co. when he was a child, he
enlisted in the Revolutionary service while a resident of Amherst Co,
and he married in Amherst Co. This last may be a mistake -- the
location of his marriage seems to be Bedford Co.
Vestal, do you have any sources for the Albemarle Co birth place?

**** Albemarle Co. VA was formed in 1744, Amherst Co. was formed in 1758
from part of Albemarle....
I've found the records of both Cos. are often combined. As our John was
born right during the 'split' - it's understandable that his Birth is listed
in both counties....
Bedford Co. was formed in 1753, also from part of Albemarle.
Most likely, John was born, married, & enlisted in essentialy the same
area......

Grandmother (Ida Lou Williams) used to tell the story of how Ray almost died as an infant because he couldn't keep food down. My grandfather(Raymer Phelps Peters Sr) always loved to snack on cheese and crackers. While snacking one evening, Granddaddy gave Ray a tiny bit of cheese...he ate it and kept it down. Grandmother then fed him cheese every day with little bits of cracker and he thrived. Strange how you remember little stories like that! He was the FBI man, for sure. He was an avid photographer, artist, naturalist, and an engineer. (Purdue University) The painting you see above the two of them is one of his. One hangs in the FBI offices in Washington DC. Ray and Shirley had a beautiful daughter named Nora Ray who died in 1965 when she was 18. She was hit by a drunken driver. Shirley died in her sixties of a brain tumor. Doug has one son, Ryan. Uncle Ray died of Alzheimer's about five years ago. He was an avid photographer, artist, naturalist, and an engineer. One of his paintings hangs in the FBI offices in Washington DC.

Sharon Alexander Bond writes Uncle Ray(Raymer Phelps Peters Jr) was a small man who had great courage...His son,( Raymer) Douglas Peters, lives in Phoenix, AZ. We went to see him 18 months ago and I'll send pictures soon. He has been very successful...very much like his father. He's an engineer and is as meticulous as his dad. Wonderful sense of humor, too. Strange how you remember little stories like that! He was the FBI man, for sure.

Christ Church at Wayside, WIlliam & Mary Parish, Charles Co. (from Scrivener's Maryland Parishes) - William and Mary is one of the original 4 parishes into which Charles county was divided. The vestrymen in 1690 were Col. John Courtes, Mr. Robert Yates, Mr. William Hawton, Mr. Henry Hardy, Mr. John Wheeler and Mr. William Harvert. The first church building was erected prior to 1691. Rector in 1692 was Rev. Mr. Moore then Rev. George Tubman from 1695-1700.

John STOUT and wife Catherine came from Shenandoah Co. VA to Washington Co. TN (which was then part of North Carolina). According to Herald F. Stout's book "Stout and Allied Families,".... his name was JOHN C. STOUT. This is incorrect.... and comes from the will of his father Daniel Stout.... the will states, "sons, John & George Benjamin Stout.... the & sign was interpreted by H. F. Stout to be the letter "C".

This is the only reference to death of John STOUT and probably his wife as well... his children are listed as orphans and are bound out to several different men:

Probably born around 1740.

John Ray is, so far the most likely candidate for the father of Thomas and John Wray of Monroe county Virginia and later Lawrence/Gallia counties Ohio. This is an attempt to piece together information on the only Rockingham county Virginia Ray family we have found in the 1770s. The reasons I have included this are because Thomas was mentioned to have come from Rockingham county Virginia in one of his county biographies, we have not, to date, found a father close by in Monroe county, Thomas and brother John's place of residence, from 1800 on. (A biographical sketch about Eli Wray, son of Thomas, is given in a history of Nodaway County, Polk Township in which some interesting data is shown. It mentions that he was the son of Thomas Wray who was from Rockingham County, Virginia, and his mother was Rachel Neal, born in Bedford County, Virginia.) Many Rockingham county families moved to the Greenbrier and Monroe county area around 1780-1790, including John Adlerson, Mathias McGlammery, Reuben Harrison, John Conner and many others mentioned as neighbors of John & Susannah. John Wray, of Monroe named a daughter Susannah. Both John & Thomas named sons John.

The only weapons are knives. Several pieces of yard goods, also sewing and darning needles. There was also a small bible. (Included because James McGowin and Robert Bell are both in Rockingham). In 1781 John Ray patented the land on Smith Creek (234 acres) which he had surveyed in 1770. Perhaps he finally had the land patented at that point because he was getting ready to leave and sell it. Curiously, he had it patented in Augusta county although the land is clearly in Rockingham county.

Note - this may not mean a thing - A John Wray paid 30 lbs. for 18 acres on Walker Creek in Montgomery County, Virginia. Paid to Thomas Shannon on 6 Oct 1795. Greenbrier Co. was formed from Montgomery Co., Virginia. He purchased 40 more acres from a land grant in 1803 bordering his own and Thomas Shannon's lines. This land was in Montgomery county VA when purchased, but later (1806) became part of Giles county. This land was to the north of Walker's Mountain and to the south of Peter's Mountain where John & Thomas Wray later purchased 60 acres and 100 acres respectively for back taxes, both paying $1. (The route from Rockingham county to Monroe county would be through the Shenandoah Valley through a pass in Botetourt county then north of Radford (very close to Blacksburg VA) through another pass which lands you at Walker's Creek. This may or may not be the John Ray who was in Rockingham county VA. In 1810 either this or another John Wray purchased 44 acres through a land grant in Montgomery county on Walker's Creek, however it does not border anyone familiar.

I, Joseph Robinson, Sr., do make and publish this as my last Will and Testament.
First, I direct that my funeral expenses and all my debts be paid as soon after my death as possible out of any moneys that I may die possessed of or may first come into the hands of my Executors. Secondly, I give and bequeath to my wife, Sarah Robinson, all the horse, cattle, hogs and other stock of whatever kind which I may die possessed of except as herein after directed, all the money I have in possession or which is due me from any and all persons, all my notes on any and all persons whether calling for money or trade, all my blacksmith tools, farming tools, and merchanical tools, of every description, all my household and kitchen furniture of every kind and description, all my grain of every kind including corn, oats, wheat and all the personal property of every kind except as hereinafter directed, everything she may raise on the land on
which I now live, every species of property she may accumulate. I also give and bequeath to her the privilege of tending, using or renting any portion of my land which she may choose, also the use and possession of my dwelling house and other buildings. Thirdly, I give and bequeath to my son, John Robinson my black horse. Fourthly, I give and bequeath to my daughter Margaret Taylor two cows. Fifthly, I give and bequeath to my daughter, Margaret Taylor, wife of Thomas Taylor my tract of land lying North of the stage road and North and west of the tract of land which I have given and deeded to my son John Robinson as far as the lower end of a clover field below where my son Zaceriah Robinson now lives and bounded on the Northeast by lands of Samuel Howard, by the fence to the point of a leading ridge, then up said ridge running a southwest course on the line described in the deed consolidating several tractrs of land including the land on which I live, then with said last mentioned line South to the land of Johnson Robinson, with the following conditions (viz) the said Margaret Taylor and her husband Thomas Taylor are to maintain, nourish and cherish my wife Sarah Robinson and in every way conduct themselves towards her as becomes children towards a parent to the satisfaction of her the said Sarah Robinson to her satisfaction she may disposess them at any time and cause them to leave her premises and in that case they shall forfeit any title to said land and this will shall convey no title to the said Margaret. As a further condition the said Margaret and Thomas Taylor or either of them shall not be permitted to cut any cordwood or any timber on said tract of land, except what may be necessary for the use of the said farm. Sixthly, I give and bequeath to my daughter Catherine Robinson and her two daughters, Hannah and Edney Caroline Robinson, the remaining portion of the tract of land which is described in State Grant No. 28031 dated on the 30th day of July, 1851, lying in Johnson County, Tennessee, District No. 7 and which has not
been conveyed by me to Margaret Taylor and Joseph Robinson, Jr. Said Catherine Robinson and her two daughters are to have an equal interest and share of said remaining portion of land whoever shall well and comfortably maintain the said Catherine Robinson and Hannah Robinson during their lifetime shall be entitled to their share of their two-thirds portions of said remaining tract and the said Edney Caroline
Robinson when she shall be of lawful age shall have full title to her one-third part of said remaining portion of land. I aslo bequeath to the said Catherine Robinson and her two daughters, twelve head of stock hogs and five head of sheep that are now in possession of my son Joseph Robinson. Seventhly, I give and bequeath to each of my children two dollars in money. Lastly, I do hereby nominate and appoint Samuel Howard and H. P. Murphy my Executors. I, Joseph Robinson, Sr., do make and publish this as my last Will and Testament.
First, I direct that my funeral expenses and all my debts be paid as soon after my death as possible out of any moneys that I may die possessed of or may first come into the hands of my Executors. Secondly, I give and bequeath to my wife, Sarah Robinson, all the horse, cattle, hogs and other stock of whatever kind which I may die possessed of except as herein after directed, all the money I have in possession or which is due me from any and all persons, all my notes on any and all persons whether calling for money or trade, all my blacksmith tools, farming tools, and merchanical tools, of every description, all my household and kitchen furniture of every kind and description, all my grain of every kind including corn, oats, wheat and all the personal property of every kind except as hereinafter directed, everything she may raise on the land on
which I now live, every species of property she may accumulate. A mariner and planter, served as Justice of St. Mary's County and on the Potomac in St. Mary's County from 1658 to 1660; on Governor's Council 28 Feb 1669. Commissioned a justice of the peace for Charles County, MD 1 Aug 1672 and served until about 1687. Member Church of England.

At a meeting of the Council heald at Mattapanye on 16 Jun 1676, the Council ordered the "Mr. Benj. Rose and Major Wm. Boarman received the foure Indian prisoners from Capt Lieut. Barton and convey them safely Over to Collonel Nicholas Spencer and in his absence to Lieut Collonel John Washington or Major Isaac Alderton" 207 (Archives of MD, Vol 15, page 92).

In 1683 he was on the committe for the advancement of trade in Charles County. In 1687 he was recommended for the council and in 1689, he was member of the commisssion to regulate civil affairs in the county and was to retain his commission.

On 22 Sep 1687, a council held in St. Mary's City appointed Capt. William Barton to a "new commission of the Peace and Tryall of Causes" for Charles County. At his recommissioning on 26 Nov 1678, he was called Capt. William Barton. In 1681 he was a Magistrate of Charles Co. Court in MD and was Captain of the Foot (infantry) of the Provincial Militia.

1689: William Barton signed a petition as a "Protestant Subject of Their Most Excellent Majesty King William and Queen Mary". He served as a vestryman in Port Tobacco Parish.

1696 listed as a civil officer of Charles County.

William Smoote, the father of Ann (Smoote) (Hungerford) Barton assigned to William Barton Jr. and Thomas Smoote and their heirs, forever, a patent for 240 acres granted to him on May 26, 1658.

At Court, Charles Co., MD Oct. 1, 1662, William Barton Jr. delivered the patent his father-in- law, William Smoote, assigned to him and his brother-in-law, Thomas Smoote on May 28, 1658, quoting: "unto his Brother-in-law Thomas Smoote for the use of William Hungerfot Junior, son of William Hungerfot, deceased." Libe A, Folio 243. His first wife Ann, evidently died in the year 1662 and for this reason the above land was returned to the child's relatives for his benefit.

Among those chosen by the principal freeholders for vestrymen and appointed at a Court held at Benedict Leonard Town on Feb 14, 1692 was Mr. William Barton. Liber K, Folio 152, 153. Later he was one of six vestrymen for Church at Charles Town called St. Pauls Parish around 1696. Liber H D, Folio 47. He was also a Vestryman for a parish at Port Tobacco, MD. Liber H D, Folio 47. This was the William and Mary Parish in Charles Co., MD.

9 Aug 1681 recorded as Capt. William Barton, Commissioner, Liber Bf.223 Md. Arch. Vol 15, page 405. In 1684 named among those regulating the affairs of the Militia in Charles County Maryland and referred to as Captain many times.

This deed proves the marriage of Mary Barton to Thomas Warren and the marriage of her sister, Elizabeth Barton to Thomas Smoote. It also proves William and Mary Barton were their parents and their marriage was solemnized before June 13, 1688, the date of the deed. 27 Mar 1689 William Barton signed an article assuring the citizens there was no planned disturbance by Indians and Roman Catholics and the purpose to kill Protestants was false. (PRO Colonial Papers, Vol. 8 Md. Arch 1687-1693. Was named at the Court at Whitehall 8 Oct 1691 as one of the most substantial Protestant inhabitants - PRO Colonial Papers, folio 8 (ibid p. 285).

With father from Warwickshire, England about 1654 to Virginia to Maryland, purchased 300 acres on St. Clement's Bay in 1658.

A mariner and planter, served as Justice of St. Mary's County and on the Potomac in St. Mary's County from 1658 to 1660; on Governor's Council 28 Feb 1669. Commissioned a justice of the peace for Charles County, MD 1 Aug 1672 and served until about 1687. Member Church of England.

At a meeting of the Council heald at Mattapanye on 16 Jun 1676, the Council ordered the "Mr. Benj. Rose and Major Wm. Boarman received the foure Indian prisoners from Capt Lieut. Barton and convey them safely Over to Collonel Nicholas Spencer and in his absence to Lieut Collonel John Washington or Major Isaac Alderton" 207 (Archives of MD, Vol 15, page 92).

In 1683 he was on the committe for the advancement of trade in Charles County. In 1687 he was recommended for the council and in 1689, he was member of the commisssion to regulate civil affairs in the county and was to retain his commission.

On 22 Sep 1687, a council held in St. Mary's City appointed Capt. William Barton to a "new commission of the Peace and Tryall of Causes" for Charles County. At his recommissioning on 26 Nov 1678, he was called Capt. William Barton. In 1681 he was a Magistrate of Charles Co. Court in MD and was Captain of the Foot (infantry) of the Provincial Militia.

1689: William Barton signed a petition as a "Protestant Subject of Their Most Excellent Majesty King William and Queen Mary". He served as a vestryman in Port Tobacco Parish.

1696 listed as a civil officer of Charles County.

William Smoote, the father of Ann (Smoote) (Hungerford) Barton assigned to William Barton Jr. and Thomas Smoote and their heirs, forever, a patent for 240 acres granted to him on May 26, 1658.

At Court, Charles Co., MD Oct. 1, 1662, William Barton Jr. delivered the patent his father-in- law, William Smoote, assigned to him and his brother-in-law, Thomas Smoote on May 28, 1658, quoting: "unto his Brother-in-law Thomas Smoote for the use of William Hungerfot Junior, son of William Hungerfot, deceased." Libe A, Folio 243. His first wife Ann, evidently died in the year 1662 and for this reason the above land was returned to the child's relatives for his benefit.

Among those chosen by the principal freeholders for vestrymen and appointed at a Court held at Benedict Leonard Town on Feb 14, 1692 was Mr. William Barton. Liber K, Folio 152, 153. Later he was one of six vestrymen for Church at Charles Town called St. Pauls Parish around 1696. Liber H D, Folio 47. He was also a Vestryman for a parish at Port Tobacco, MD. Liber H D, Folio 47. This was the William and Mary Parish in Charles Co., MD.

9 Aug 1681 recorded as Capt. William Barton, Commissioner, Liber Bf.223 Md. Arch. Vol 15, page 405. In 1684 named among those regulating the affairs of the Militia in Charles County Maryland and referred to as Captain many times.

This deed proves the marriage of Mary Barton to Thomas Warren and the marriage of her sister, Elizabeth Barton to Thomas Smoote. It also proves William and Mary Barton were their parents and their marriage was solemnized before June 13, 1688, the date of the deed. William Barton III
May 11, 1696, he took the oaths appointed by the Act of Parliment. July 6, 1696 he had charge of the funds provided for Free Schools. He was Major William Barton when he was at the Council on May 14, 1697 and he was appointed to go to Virginia to strive with the Emporer of the Piscattoway Indians and his other great men to influence them to return to Maryland to live on their own habitation. Liber H D F, Folio 480, 498.

At the Council on Nov 10, 1698 Major William Barton was recommended to be commissioned Sheriff of Prince George Co., MD. The Records of the Proceedings of the General Assembly of the Upper House in 1704 reveal the services of Lt. Col. William Barton many times. His health became a problem. On Sep 25, 1704, a move was made and granted "that he might have leave to go home for recovery". He was present Dec 5, 1704 and on May 17, 1705. On Apr 2, 1706 at Roll Call for Prince Georges Co., MD William Barton was deceased. Orders were made to elect some one to serve in his place. The probate of his will proves he died before Nov 6, 1705 at the age of 38 years.

The following notes were supplied by Donna Bott of Valdese, North Carolina:
Was in London in 1633 as a member of the Boatwright Guild. He agreed to work for 50 days in Virginia for Colonel Thomas Burbage, sailing from England to settle at Hampton, York County (now Elizabeth City, VA). It is not clear exactly when he came to America.

First public record 24 Feb 1642 when granted 400 acres of land in Yorke County on the north side of the Charles River near the head of Tymber Creek. To Maryland in 1646; lived on 300 acres, "Smoote", in Poplar Hill Hundred, St. Mary's County. Also 400 acres, "Smootly" in Manor of West St. Mary's on the west side of Wicomico River at the head of Smoot's Branch.

Probably raised in England and took oath there or in Virginia.

Planter, carpenter, shipwright. He designed and built vessels used in trade between Maryland and Virginia. How big these vessels or enterprise is not clear, two vessels were pinnaces, small sailing ships.

In 1644 William Smute gave George Codd 3 barrels of corn and clothes for fulfilling his indentured service.

William Smute fought in the campaign against the Pamunky and Chicka hominy Indians, receiving 600 pounds of tobacco 1 Oct 1644 for his services.

12 Jun 1647 granted by Lord Baltimore's Land Office 300 acres near the mouth of Herring Creek on the manor of New Towne in what is now St. Mary's County, MD.

17 Apr 1650, William Smoot and his son-in-law, William Hungerford, signed Stone's declaration saying "We the said Lieutenant, Council, Burgesses, and other Protestant inhabitants (enjoy) all fitting and convenient freedom and liberty in the exercise of our religion under his Lordship's Government and interest."

William was alive when his wife died in Jan 1666 but dead by 1670.

The Smoote family, who were William Smoote's ancestors of earlier days, were natives of Netherland. Marriages occured between the House of Smoote and the noblity and gentry of that Province. A coat-of-arms was found. William Smoote of Maryland had the name and traditions of the Dutch House of Smoot and those in Maryland bore a coat-of-arms.

Aug 1637, William Smoote witnessed the deed of William Reynolds to Thomas Denham. Deeds, Orders, Wills No. 1, page 64 York Co., VA.

At some time William Smoote paid for the transportation of eight persons to the Virginia Colony. The names of these people were omitted on the patent he received. It is normal to think they were members of his own family and perhaps some who would be in his employment. They positively arrived some time before the following patent was granted to him, quoting; "To all &c whereas now known yee that give and grant unto William Smeete fouer hundred acres of Land in the Countie of Yorke neare the head of a Creeke called Tymber Neck Creeke on the north side of Charles river beginning at certaine marked trees that runs from Timber Neck Creeke north northwest three hundred eightie pole and divides this Land from the Lands of McMinifer and from thence East north East two hundred and fiftie poles South South East into a branch of Timber Neck Creeke and then down the branch unto he marked trees where it begann which four hundred acres of land being due unto him by and for the transportation of eight persons into this Colony to have and to hold &c to bee held &c yarling and paying &c which payment is to bee made seaven years after this iiiith of February 1642. William Smoote and family resided in York Co., VA in the years 1642 to 1646. He was a boatwright during those years and attended to his affairs through the courts as was the custom of that era. They resided in Hampton and it was there that he carried on his construction of various types of boats, such as the early settlers needed. He moved to Maryland in 1645. He placed his estate into the possession of Joseph Hill who stood bound with him for a debt to be paid to Ashwell Batten on the following Nov 10, 1645. This covered his real estate and personal property.

Apr 6, 1646, a survey was ordered for 300 acres of land for William Smoote, his wife and his two children, who came into the Province in 1646.

At some time in Virginia William Smoote married the second time Mrs. Grace Wood, a widow. They were the parents of Elizabeth Wood - William Smoote named Elizabeth as his wife's daughter.

There has not been found anything regarding any administration of his estate. They may have been lost.

William Smoot haueing obtayned a referance the last Court against the suit of Mr James Linsey to prepare himself to defend his Cause and hauing nothing to obiect against the sayd Linsey formar Declaratione The sayd Linsey by his Atturney George Thompson Craued an Order according unto his formar petition, which was granted.

Complaineth against the sd Thom. for the whereas the sd Thom did in th xxxvii yeare of the Dominion of Caecilius 1668 agree With & faithfully promise unto the sd William that is to say that he the sd Thomas would well & truly teach W Hungerford to write & Cast Accts in Consideracon whereof the sd William did pay unto him the sd Thom one boate of foureteene foot by the Keele one Cow & one yearleing Heffer Yet notwfhstanding the sd Thom his sd obligacon & agreement little regarding but minding & fraudulently intending him the sd William of the sd boate & Cattle to deceive neither hath performed his sd agreem' but shortly after goeing out of the Country th sd youth negligently did leave untaught & now doth altogether refuse to make him the sd William any reparacon whereby th sd William sth he is damnified to the Valew of 2900 lbs of tobacco & thereupon he bringeth his suite Whereupon the Def replied that the pl. never made any bargaine With him for to teach the sd youth Wth his mother Mrs Legatt & that when he was out of the Country Mr Blakiston did teach the said youth.
